My understanding is that if there was FRAUD in getting the vaccines approved, then Pfizer/Moderna can be sued, even with the Act in place.
And I just saw that a whistleblower from J&J has already stated that they cut corners due to Govt and other pressure to get the J&J vaccine to market.
In my view, since it was Congress that put the PREP Act in place, it's more appropriate for Congress, as representatives of the people, to repeal it. An outright appeal by Congress prevents court appeals from being fought for months or years.
Rather than asking a corrupt, captured Judiciary to decide, trusting it to find obvious, legal "fraud" when the Judicial Branch appears to be overwhelmingly beholden to the military pharmaceutical complex.
I'd always prefer the PEOPLE through their Congressional representatives to take action in their own best interest instead of appealing to untrustworthy "authority" for relief.
